The Privacy Policy describes the privacy practices of Happy Africa Tours Ltd (the Company) and all the websites run by the Company, namely www.happyafricatours.com (hereinafter: Happy Africa Tours) and www.happymoroccotours.com (hereinafter: Happy Morocco Tours).  

 

Who we are

Happy Africa Tours (website address: https://www.happyafricatours.com) is a travel site specialized in shared and private tours and trips in East Africa. The website is run by Happy Africa Tours Ltd. a Kenyan based international tour operator company. (Reg.no.: CPR/2015/176615, P.O.  Box 13242-00200 Nairobi). Happy Africa Tours Ltd. is committed to protecting your personal information. In this document we summarized our Privacy Policy and what it means for you. What is personal information and how do we use or disclose it?

Personal information is any information that makes it possible to identify an individual. It includes name, contact information, phone number, passport (or ID) number, payment details and other information described below.

Comments

When visitors leave comments on our websites we collect the data shown in the comments form. We also collect the visitor’s IP address and browser user agent string to help spam detection. An anonymous string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service Privacy Policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Contact forms

When visitors contact us via contact forms we collect the data shown in the comments form. We also collect the visitor’s IP address and browser user agent string to help spam detection. Data collected via contact forms are used solely to get back to you and answer your questions.

Booking Travel

The Company may collect, use or disclose your personal information for the purposes of booking travel services on your behalf. Such information may include: name, age, date and place of birth, address, phone number, e-mail address, emergency contact information, passport information, travel medical information (where required), insurance details, ISIC information (where applicable), nationality, residency, nutrition preferences, trip evaluations, travel and accommodation preferences, comments you provide us, trip destination information, and payment-related information. This personal information enables us provide you with trip information, book services, accommodations, process payments, and provide similar travel services. Please be aware that The Company may be required to provide certain personal information to our service providers in order to confirm services. (E.g. if you book hotels with us, we need to send your name, age, nutrition information, nationality and residency to the hotel.) When you book any travel services with us, you are consent to the collection, use and disclosure of your personal information for the purposes of administering and delivering the travel services you requested. Your personal information may also be used for the purposes of:

  • Enabling us to better understand your needs as a customer and determine eligibility for our products and services;
  • Informing you about our products and services, or those of our partners that we believe may be of interest to you (provided that we have received valid consent from you, if such consent is required);
  • Providing ongoing service and support, including resolution of any issues with the services or products you request from us;
  • Ensuring the safety and security of our passengers and products;
  • Carrying out internal accounting and administration of our business;
  • Complying with laws, regulations, and immigration requirements.

Contests and Newsletters

We may also collect personal information, including contact information such as name, address, and phone number or email address if you elect to enter a contest or promotion with us, subscribe to our newsletter, or request a brochure. We use this personal information for the purposes of administering the contests/promotions or delivering the information you request.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website. Employment We collect personal information from those individuals applying for employment or similar positions at our company to the extent necessary to (i) identify the individual and (ii) evaluate their suitability for the applied-for position. This information may include name, contact information, educational and employment background, criminal record verification, residency and/or citizenship information, and other information necessary for us to screen potential employees and staff.

Service Provider Arrangements

In addition to the third party travel suppliers outlined above, we  may transfer your personal information to third parties who provide services on our behalf. For example, we may use service providers to authorize and process payments, host our customer service operations, serve advertisements on our website, send email or other communications, or run our contests and promotions. Our service providers are given the information they need to perform their designated functions, and they are not authorized to use or disclose your personal information for their own purposes.

Transfer Data of European Citizens Outside Europe

Please note that if you are resident in the UK, European Union or European Economic Area (“EEA”) we hold your personal information outside of the EEA, namely  in Kenya and Morocco. We may also need to transfer your personal information to travel suppliers and other third parties outside of the EEA (e.g. Kenya, Morocco, Tanzania, Uganda). Countries outside of the EEA may not have the same level of privacy laws as exist in the UK, Canada and the EEA. However, we take reasonable steps to ensure that your privacy rights are protected in accordance with EU and EEA regulations.

Legal and Compliance

We and our service providers may provide your personal information in response to a search warrant or other legally valid inquiry or order, to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required or permitted by applicable law. We may also disclose personal information where necessary for the establishment, exercise or defense of legal claims and to investigate or prevent actual or suspect loss or harm to persons or property.  

 

How is your personal information protected?

We have implemented measures designed to help protect personal information in our custody and control. We maintain reasonable administrative, technical and physical safeguards in an effort to protect against unauthorized access, use, modification and disclosure of personal information in our custody and control. Unfortunately, no collection or transmission of information over the Internet or other publicly accessible communications networks can be guaranteed to be 100% secure, and therefore, we cannot ensure or warrant the security of any such information. We have personal information retention processes designed to retain personal information of our customers for no longer than necessary for the purposes stated above or to otherwise meet legal requirements.  

 

How long we retain your data?

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. For users that register on our websites (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information. Personal data you provide via contact forms and during bookings are retained for as long as administrative, legal or security reasons warrant it.  

 

What rights you have over your data?

If you have an account on this site, or have left comments, you can request to receive all personal data – including any data you have ?provided to us – we hold about you via email. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes. You have the right to access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law. You may access, update, and/or correct much of your personal information through your account on our websites, or you may request access, updates and corrections of inaccuracies in personal information we have in our custody or control by emailing or writing to us at the contact information set out above. We may request certain personal information for the purposes of verifying the identity of the individual seeking access to their personal information records. As well as a right to access, update and correct information we hold about you, if you are resident in the UK, European Union or European Economic Area then you have the following additional rights:

  • To be told how long your personal information will be retained by us or the basis on which we make decisions about how long we retain your personal information;
  • To require that your personal information is deleted by us, subject to any necessary legal requirements we may have to retain the information;
  • To object to our processing of your personal information or to restrict processing of your personal information (but we may be unable to provide certain services to you without processing this information);

Website Policies and Cookies

Third party vendors may show Happy Africa Tours’s ads across the internet. These third party vendors use cookies to serve ads based on a user’s prior visits to our website.
